These Terms of Service ("Terms") govern your access to and use of the RackCity.ai website, application, and related software and services (collectively, the "Service"), operated by RackCity.ai ("RackCity", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service — including all software, source code, layout and design algorithms, user interface, text, graphics, and other content (excluding content you submit) — is the exclusive property of RackCity.ai and is protected by copyright and other intellectual property laws. All rights not expressly granted to you are reserved.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal warehouse-planning purposes. You may not, in whole or in part:
(a) copy, reproduce, republish, or distribute the Service's source code or any portion of it; (b) decompile, reverse-engineer, or attempt to derive the underlying algorithms or structure of the Service except to the limited extent applicable law expressly permits; (c) modify, adapt, or create derivative works of the Service; (d) sell, rent, lease, sublicense, or otherwise commercially exploit the Service; or (e) remove or obscure any copyright, proprietary, or other notice contained in the Service or its source files.
You agree not to use the Service to violate any law, infringe the rights of others, or interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or related systems.
You retain ownership of the warehouse designs and data you create using the Service. You grant us a limited license to store and process that content solely to operate and improve the Service.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. Warehouse layouts and calculations produced by the Service are for planning purposes only and are not a substitute for professional engineering, structural, or safety review.
To the maximum extent permitted by law, RackCity.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. The provisions governing intellectual property, restrictions, disclaimers, and limitation of liability survive termination.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
